Massena man fined for shooting goose in village from mother's porch
MASSENA - A Massena man has been fined $150 after he admitted he was hunting out of season when he fired a shot out of his mother's living room that killed a goose during an incident that took place in April 2011.
Massena Village Justice Eric J. Gustafson fined Michael J. Boychuk, 27, of 40 Ames St., Massena, $150 for his conviction for taking small game out of season in a plea bargain agreement that satisfied several other charges.
Village police had charged Boychuk with second-degree reckless endangerment, discharging a firearm in the village, discharging a firearm within 500 feet of a dwelling, taking small game during closed season, hunting small game without a license and taking a goose with a .22 rifle. Village police were assisted by Department of Environmental Conservation police.
Police said Boychuk fired four shots from his mother's living room window on River Street, killing one goose and critically injuring a second goose that later needed to be dispatched. He told police he was simply trying to eliminate a nuisance.
Police said a neighbor was on the riverbank near the geese and was struck by branches that fell after being struck by the shots.
He reportedly told Boychuk police would be responding to the scene, and police said Boychuk tossed the geese, including one that was still alive with a severe injury, into the river.
Police said the neighbor waded four feet into the river and brought the two geese back to shore.
In other recent court action before Judge Gustafson:
• Marsha J. Garrow, 27, of 8 Victory Road, Massena, and Faith J. Deshane, 31, of 112 Woodlawn Ave., Massena, were each fined $25 and a $125 surcharge for a trespassing conviction.
The charges stemmed from an incident at 2:27 a.m. Jan. 14 when the two women allegedly went to 7 Tracy St. and attempted to get a clothing for Garrow's baby from her ex-boyfriend, Shawn Biter.
Megan Derouchie reportedly told police the two women refused to comply with her request that they leave the property.
• Megan M. Vallance, 20, of 1 Grinnell Ave., Apt. 3, Massena, was granted an adjournment in contemplation of dimissal with a stipulation she perform 10 hours of community service.
Vallance was charged with unlawful possession of alcohol by a person under 21 after she was allegedly found in possession of a beer at 11:15 p.m. Sept. 27 at Charlie's Tavern.
• James I. Paquin, 24, of 64 Sycamore St., Massena, was sent back to the St. Lawrence County Correctional Facility with bail continued at $1,000 cash or $2,000 bond on fifth-degree criminal possession of stolen property and third-degree aggravated unlicensed operation of a motor vehicle charges. He has been incarcerated since being picked up on a bench warrant on Saturday for failing to appear in court as directed,
The stolen property count alleges Paquin was in possession of two televisions - a 19-inch Sharp flat screen and a 32-inch RCA television and DVD player - on Nov. 7, 2010 that had been stolen from Dale Bressard.
Paquin reportedly traded 2 1/2 Oxycontin pills to Mr. Bressard's nephew, David, for the two televisions, according to court documents. The televisions were valued at $650.
