Grand jury voted to indict Trimm
NORFOLK — A St. Lawrence County grand jury has voted to indict a Winthrop man who was charged with murder Feb. 2, according to court documents filed in County Court.
Dustin J. Trimm, 37, of 325 County Route 49, Winthrop, will be indicted when the report is brought up in open court.
Because of the indictment filed by Assistant District Attorney James L. Monroe, a preliminary hearing scheduled for Monday in Norfolk Town Court did not happen.
Trimm was charged with second-degree murder for allegedly shooting Jason M. Wing during the last week of August or the first week of September, 2010, and burying his body at 281 Grantville Road, according to paperwork filed in Norfolk Town Court.
Norfolk court officials said Monday that Trimm waived his preliminary hearing.
Trimm’s attorney, Richard V. Manning, Parishville, claimed that did not happen.
“I would never waive a preliminary hearing,” Mr. Manning said.
Mr. Manning said it took hours for him to get basic court documents about the charges. He said he is trying to get more information about the case.
State police investigators closed the scene Friday after searching for the murder weapon — a gun.
Citing anonymous sources, Channel 7 stated the weapon had been found, but authorities wouldn’t confirm nor deny that report.
Calling hours for Mr. Wing were Tuesday and the funeral will be private.
Dr. Michael Sikirica, Albany, determined Friday that the manner of death was a gunshot wound to the head.
Mr. Wing’s mother, Roxanne Stratton, said Trimm was a friend of her son’s but she has long believed he was responsible for his disappearance.
Trimm has a long rap sheet, including a 1997 felony conviction for sodomizing a 15-year-old boy.
He is listed as a Level 2 sex offender in the state registry.
He owned Triple X Adult Super Store in Fort Jackson and was convicted of impaired driving in 2002. He was charged with felony driving while intoxicated in May 2010.
Trimm is being held at St. Lawrence County jail, Canton, without bail.
