CANTON Two years after a Gouverneur woman died in car accident, her family has filed a lawsuit against the person they say caused the accident.
Shirley A. Hays, 69, was driving a minivan with her step-great-granddaughter Angela Scott, 8, on Aug. 21, 2010, when state police say a pickup driven by Shawn M. Trimm, Gouverneur, crossed into oncoming traffic on Route 11.
The accident resulted in the death of Angela and Ms. Hays.
In the five-page lawsuit filed Thursday in state Supreme Court by Michael J. Hays, the family is asking for a money judgment for shock and emotional distress Ms. Hays endured before her death.
The lawsuit alleges Mr. Trimms recklessness caused the accident. It accuses him of failing to use care and caution or properly using his horn before the collision.
Mr. Hays is represented by James Reid, of Syracuse.
