CANTON A Massena church filed a lawsuit Monday in state Supreme Court against a contractor it hired to do repairs after a worker was injured for alleged unsafe working conditions.
Emmanuel Congregational United Church of Christ was previously sued by Andrew Wojtowecz. As a result of that legal action, church officials had to spend considerable amounts of money to defend themselves.
Church officials now seeks to get that money back.
According to the lawsuit, Emmanuel Church was not at fault for the Wojtowecz injury. That fault lands with the construction company the church hired, the lawsuit alleges.
The church hired Rivercrest Enterprises, who were insured by Erie Insurance Company. But the insurance company isnt paying the church because they say the action is not covered under its policy with Riverside Enterprises.
The church though is asking for a money judgment against both the construction company and its insurance company.
