CANTON An Ogdensburg landlord who allegedly had a physical conflict with a tenant, then drove drunk, was indicted Tuesday by a St. Lawrence County grand jury.
Kevin S. McAllister, 44, of 508 Crescent St., was charged with aggravated driving while intoxicated and two counts of driving while intoxicated, all class E felonies.
Mr. McAllister allegedly grabbed a tenants arm in front of two children before leaving the house, after arguing about the propertys condition on Feb. 19. The tenant then told deputies that Mr. McAllister was intoxicated.
Mr. McAllister was pulled over shortly after and tested at a 0.19 percent blood alcohol content while traveling on Horseshoe Road in Oswegatchie. Aggravated DWI charges apply when a BAC is measured over 0.18 percent.
In other grand jury action:
■ Daniel V. Dominie, 39, of 522 King Street, was charged with felony aggravated driving while intoxicated, pursuant to Leandras Law, and driving while ability impaired by drugs.
Mr. Dominie is accused of being under the influence of meprobamate while driving on New York Avenue in Ogdensburg on Jan. 7 with 13-year-old Austin M. Eggleson in the car.
Leandras Law makes driving intoxicated or impaired by drugs with a child under age 15 an automatic felony. It passed in 2009, honoring an 11-year-old killed earlier that year in a New York City car accident,
■ Arley L. Dahlbert, 28, of 272 County Route 11, Ogdensburg, was charged with third degree criminal possession of stolen property, a class D felony, third-degree unauthorized use of a vehicle and fifth-degree criminal possession of stolen property, both class A misdemeanors.
Mr. Dahlbert was accused of stealing a 2012 Dodge Journey belonging to Michael Chambers on Prospect Street on June 15.
He was also accused of stealing an Insignia GPS unit owned by Kyle Best.
■ Philip F. Saxby, 56, of 220A Highland Road, Massena, was charged with fourth-degree grand larceny, a class E felony.
Mr. Saxby was arrested on Jan. 14 after allegedly stealing a gold and diamond wedding ring, valued at $2,700, belonging to Shirley Moniere.
Mr. Saxby allegedly stole the ring while repairing a door inside her residence, according to court documents.
■ Mario Giacco, 48, of 2115 Moravia Venice Townline Road, Moravia, and William J. Mumm Jr., 26, of 108 Davis Road, Lansing, were both charged with second-degree criminal possession of marijuana, a class D felony.
They are accused of possessing 4.5 pounds of the drug on Jan. 8 in the town of Waddington, according to the indictment report.
