FELONY DWI - MASSENA - A 32-year-old Ogdensburg man was jailed Wednesday morning after being stopped by troopers at 7:38 a.m. Wednesday on state Route 131 in the town of Massena.
Massena-based state police charged Dwain A. Mashaw of 69 MacIntire Road, Ogdensburg, with felony counts of driving while intoxicated and first-degree aggravated unlicensed operation of a motor vehicle. He was also charged with refusal to take a take a roadside breath test and an open container violation and was ticketed for failure to keep right. Troopers said Mashaw later agreed to take a breathalyzer test and had a blood alcohol content of 0.15 percent. A blood alcohol content of 0.08 percent or higher constitutes a driving while intoxicated count in New York state.
Troopers said Mashaws license had been revoked following a May 2009 driving while intoxicated conviction from Ogdensburg City Court.
His operating privileges had also been suspended in August 2009 for failure to pay a drivers responsibility assessment and in March 2007 for failure to pay fine.
Troopers said they made a traffic stop after allegedly observing Mashaw driving recklessly and failing to keep right on Route 37 and Route 131.
Mashaw was arraigned by Massena Town Justice Gerald P. Sharlow and sent to the St. Lawrence County Correctional Facility with bail set at $5,000 cash or $10,000 bond.
