HELENA - Massena-based state police are continuing their investigation into an accident between a utility vehicle and acar that occurred at approximately 3:45 p.m. Friday on County Route 37 approximately 200 yards from the Mahoney Road and a short distance from the Franklin County border.

Troopers said a utility vehicle operated by Kathleen M. Empey, 64, of Factory Road, Bombay, was westbound on County Route 37 when she apparently pulled into the path of car driven by Ashley Elizabeth Cumming, 23, of Garvin Avenue, Massena.

Ms. Empey was transported to Massena Memorial Hospital by Tri-Town Rescue for treatment of head, back and neck pain. Troopers said she had been stabilized Friday evening and being treated Massena Memorial Hospital.

The initial police investigation has determined both vehicles were westbound on County Route 37 when the utility vehicle pulled off to the side of the road. As the driver of the car pulled into the passing lane to go around the vehicle, the utility vehicle reportedly re-entered the roadway, crossed into the passing lane and struck the car.

Empey was ejected from her vehicle and thrown to the roadway.

In addition to the state police, the Helena Volunteer Fire Department, Helena First Responders, Seaway Valley Ambulance, U.S. Border Patrol and the forest rangers also responded to the scene.

Troopers said their investigation is continuing, and tickets are pending.
