Massena man sentenced to probation for sex crime conviction

MALONE - A Massena man charged with having sexual contact with a person under 17 years of age has been sentenced to probation by Franklin County Court Judge Robert G. Main Jr.

Media Provost IV, 27, of Massena was sentenced to 10 years probation and fined $5,000 for two counts of third-degree criminal sexual act.

He pleaded guilty to the charge by superior court information, admitting that he engaged in oral or anal sex with a minor under age 17 on Feb. 4, 2011.

Superior court information means a defendant is willing to enter a plea of guilty and thereby waive their rights to have their case heard by a grand jury and take the case to trial.

In county court business before Judge Main on Monday:

A New York City woman was sentenced to probation in Franklin County Court on Monday after admitting she to attempted to smuggle heroin into Upstate Correctional Facility last year.

Martha Diaz, 50, was ordered by Judge Robert G. Main Jr. to serve two concurrent terms of five years probation supervision and TO pay $4,000 in fines for convictions for one count each of third-degree criminal possession of a controlled substance and first-degree promoting prison contraband.

Diaz was found to be in possession of 20 glassine containers containing 6.6 grams of heroin into Upstate Correctional Facility while visiting a friend on Dec. 18.

At the time, state police said the arrest was made pursuant to an on-going investigation conducted by the narcotics division of the New York State Department of Corrections and Community Supervision Inspector General’s Office.

She could have faced a maximum sentence of 9 years in state prison.
