BANGOR A Brushton man has been charged with criminally negligent homicide in connection with an August crash that left another driver dead.
Justin C. Supernault, 21, was arrested Tuesday by state police following investigation into the wreck that killed Cody D. OConnor, 21, of Moira.
Mr. Supernault also faces misdemeanor charges of driving while intoxicated, first offense, and first-degree operating a motor vehicle while impaired by drugs, as well as failure to keep right on a two-lane road.
Troopers said that at about 4 a.m. on Aug. 4, Mr. OConnor was driving westbound on County Route 8 in the town of Bangor in front of a vehicle operated by Mr. Supernault. Both drivers lost control at a slight curve in the road, troopers said, with Mr. OConnors vehicle striking an embankment. Mr. Supernaults vehicle then struck an embankment and overturned, striking Mr. OConnors vehicle. Both vehicles were demolished.
Mr. OConnor was pronounced dead at the scene.
State police at Malone said Wednesday that Mr. Supernault was operating while impaired by marijuana and had a blood alcohol content of 0.17 percent. Under state law, a BAC of 0.08 percent or more constitutes intoxication.
Supernault was arraigned in Bangor Town Court, where he pleaded not guilty prior to being released under probationary supervision. He is to appear again on Jan. 28.
