Border agent from Heuvelton convicted of falsifying records


HEUVELTON - A St. Lawrence County man was convicted in federal court this week on two felony counts of falsifying records while working as a U.S. Customs and Border Protection Officer agent at the Alexandria Bay Port of Entry.

Todd Tyo, 48, of Heuvelton, was indicted and arrested in October 2011 on accusations that he embezzled more than $1,000 from March to August of that year while inspecting commercial trucks coming into the United States from Canada.

Following a six-day trial at U.S. District Court in Utica, Mr. Tyo was found guilty of making false entries in a U.S. Customs and Border Protection cash register computer. He was acquitted of other charges alleging that he stole money collected as payments by truck drivers, and of obstruction of justice in connection with investigation into the alleged thefts.

The jury did find that on April 13, 2011 and July 14, 2011, Mr. Tyo created false “no sale” entries in the register system to conceal payments received from truck drivers.

Contacted Friday, a U.S. Attorney’s Office spokesman in Syracuse said he did not have information about how much cash was involved in those two transactions.

A 15-year veteran, Mr. Tyo was placed on administrative leave in August 2011. He remains on indefinite unpaid suspension pending sentencing and administrative review, Customs and Border Protection public affairs liaison Thomas Rusert confirmed Friday.

Mr. Tyo faces up to five years’ imprisonment, a fine of up to $250,000, a three year period of supervised release and a special assessment of $100 on each count of conviction, the U.S. Attorney’s Office said.

Sentencing is set for May 10.
