Grand jury indicts three for driving while intoxicated

CANTON — A St. Lawrence County grand jury has indicted three people on driving while intoxicated and driving while ability impaired charges, including an Ogdensburg woman who allegedly was caught driving under the influence of a sedative with two preteen children in the car.

Tina M. Murray, 40, of 15 Big Island Drive, Ogdensburg, was arrested on Aug. 16 after police said she was driving a 2001 Chevrolet on Rosseel Street in the city while using diazepam. In the vehicle were two children, both age 10, police said, although court documents did not specify their relationship to Ms. Murray.

The grand jury indicted Ms. Murray on one count of driving of driving while ability impaired by drugs and two counts of driving while intoxicated in connection with the incident. Court documents made no reference to alleged use of any substance other than diazepam.

Also indicted were:

■ Shawn R. McIntyre, 28, of 1553 Route 812, Gouverneur was arrested Oct. 21 for allegedly operating a 2005 Dodge on Route 58 in that town with a blood alcohol content of 0.22 percent. Under state law, a BAC of 0.08 percent or more constitutes intoxication. Aggravated DWI is charged when the BAC is 0.18 percent or more.

The grand jury indicted Mr. McIntyre on one count of aggravated DWI and two counts of DWI.

Assistant District Attorney Amanda N. Nissen said Mr. McIntyre had a previous misdemeanor DWI conviction in 2006.

■ Travis J. Nelson 32, of 15 Madrid Ave., Potsdam, was arrested Oct. 28 for allegedly operating a 2006 Ford on Maple Street in that village with a BAC of 0.21.

The grand jury indicted Mr. Nelson on one count of aggravated DWI and two counts of DWI.

Ms. Nissen said Mr. Nelson had a previous misdemeanor DWI conviction in 2009.
