MALONE - A Brushton man was sentenced to probation after pleading guilty to criminally negligent homicide and misdemeanor DWI following an August 2012 crash that left a 21-year-old Moira man dead.
Justin C. Supernault, 22, was sentenced to five years probation for the criminally negligent homicide charge and three years probation for the DWI. He is also set to pay a $1,000 fine and had his license revoked in Franklin County Court before Hon. Robert G. Main Jr. on Tuesday.
Supernault was originally charged with criminally negligent homicide, DWI–misdemeanor, DWAI–drugs, and failure to keep right following a car wreck on Aug. 4, 2012 that killed Cody D. OConnor, 21.
New York State Police stated in past reports that at around 4 a.m. on Aug. 4, OConnor was driving westbound on county Route 8 in Bangor. Supernault was following him.
At a curve in the road, both drivers lost control of their vehicles, according to troopers, who said that OConnors vehicle hit an embankment. Supernaults vehicle also hit an embankment and overturned, hitting OConnors vehicle.
OConnor was pronounced dead at the scene by officials.
Both vehicles were damaged beyond repair.
Malone-based state police said in December 2012 that Supernault was driving while his ability was impaired by marijuana and his blood alcohol content was measured at 0.17 percent. The legal BAC is .08.
