Troopers: Dekalb Junction man had BAC more than three times legal limit after Potsdam accident


AGGRAVATED DWI - POTSDAM - Canton-based state police charged David W. Simmons, 20, of DeKalb Junction with aggravated driving while intoxicated Tuesday afternoon following an investigation into a one-vehicle rollover accident on Route 11 in the town of Potsdam.

Troopers said they responded to the accident at 3:20 p.m. Tuesday and determined Simmons had been operating a 2012 gray Chevrolet Impala on Route 11 when he exited the north shoulder of the road and struck a snow bank. The vehicle then overturned onto its roof. Simmons was not injured. He was also ticketed for speed reasonable and prudent.

Troopers said Simmons had a blood alcohol content of 0.27 percent, more than three times the legal limit of 0.08 percent. A DWIcharge is elevated to the more serious aggravated DWI count when the blood alcohol content is 0.18 percent or higher.

He is to appear Feb. 13 in the town of Potsdam Court.
