Brushton karate instructor’s child porn trial pushed back again


BRUSHTON - The trial of former Brushton and Chateaugay karate instructor Ryan Staples, who has been accused of producing child pornography, has been pushed back again due to “newly discovered additional evidence,” according to court documents.

Defense attorney Mark E. Anderson filed another 60-day continuance order last week, citing new evidence from the government that the defense needs time to review.

Further time was also needed to review discovery in the case and determine what motions, if any, to file and prepare for trial.

The trial won’t occur until at least mid-May, and only then if negotiations for a plea agreement with the U.S. Attorney’s Office fail.

Staples will remain detained in the Clinton County Jail pending a trial or agreement.

He was indicted in November on three counts of production of child pornography, each involving a different boy, and one count of possession of child pornography.

Court documents allege on three separate occasions Staples “employed, used, persuaded, induced, enticed, and coerced a minor male... to engage in sexually explicit conduct; took digital images of such conduct; and transferred and transmitted the visual depictions of such conduct to a computer... so that they could be published and viewed.”

If convicted, Staples faces fines and a statutory minimum of 15 to 30 years in prison for producing child pornography and five to 20 years in prison for possession and transport of child porn.

He will also be required to forfeit the two computers seized from his home containing the alleged pornographic images to the government.

The new trial date is set for 10 a.m. May 13 in Albany.
