FUGITIVE FROM JUSTICE - MASSENA - Village police picked up Derek E. Hebert, 42, of Massena on a fugitive from justice warrant at 2:11 p.m. Wednesday.
The warrant had been filed by the District Court in Wharton County, Texas. Hebert allegedly violated a 10-year probationary sentence following his conviction on an aggravated robbery count in Texas. The warrant was issued on July 19, 2003.
Police said Hebert had been staying with his brother on Maple Street and came to the attention of authorities when he expressed an interest in working as a confidential informant to assist police with drug investigations in the area. Police said when they did a background check they discovered the fugitive from justice warrant. Texas authorities told village police they would travel to St. Lawrence County to pick up Hebert.
Hebert was arraigned on the warrant by Massena Town Justice Gerald P. Sharlow and sent to the St. Lawrence County Correctional Facility with no bail set.
Hebert told the court he had been picked up previously on the warrant and Texas authorities opted not to extradite him. He told village police Texas officials told him as long as he stayed out of their state he would face no legal repercussions on the probation violation.
Mr. Sharlow said if Texas authorities dont pick Hebert up in the statutory time frame he will be released from custody.
