FELONY DWI - MASSENA - Massena-based state police charged Joel J. Dupree, 52, of 700 County Route 42, Massena, with a felony count of driving while intoxicated and ticketed him for failure to yield the right of way to an emergency vehicle at 2:30 a.m. Friday following a traffic stop on County Route 42. Troopers allege Dupree nearly struck two marked state police patrol vehicles and a Massena Village Police marked unit with their emergency lights activated on a traffic stop on County Route 42. He allegedly had a blood alcohol content of 0.21 percent. A blood alcohol content of 0.08 percent or higher is considered proof of intoxication in the state. The charge is elevated to aggravated DWI when the blood alcohol content is 0.18 percent or higher. Dupree was charged with a felony since he had a prior conviction for a misdemeanor count of DWI within the past 10 years. He was reportedly convicted of DWI on March 17, 2011 in Plattsburgh. He was arraigned by Massena Town Justice Gerald P. Sharlow and released on his own recognizance. The court suspended his operating privileges pending prosecution of his case. He was represented at his arraignment by St. Lawrence County Assistant Public Defender Robert Ballan under the county program that provides alleged offenders with an attorney at their initial felony arraignment.
