NORFOLK — The attorney for a Winthrop man who was charged with murder Wednesday says his client did not waive a preliminary hearing but was indicted by a St. Lawrence County grand jury.

Dustin J. Trimm, 37, of 325 County Route 49, Winthrop, was charged with second-degree murder for allegedly shooting Jason M. Wing during the last week of August or the first week of September 2010 and burying his body at 281 Grantville Road, according to paperwork filed in Norfolk Town Court.

Norfolk court officials said Monday that Trimm waived his preliminary hearing.

Trimm’s attorney, Richard V. Manning, Parishville, said that did not happen.

“I would never waive a preliminary hearing,” Mr. Manning said.

According to Mr. Manning, a notice was filed with Norfolk Town Court by Assistant District Attorney James Monroe that said a grand jury voted Feb. 2 to indict Trimm.

Within 144 hours after being arrested for a felony, a defendant must either be indicted by a grand jury or after a preliminary hearing a judge must say there is enough evidence for the case to go to trial.

The indictment has not been opened in County Court.

Trimm is being held at St. Lawrence County jail, Canton, without bail.

Jeffrey D. Wait

Saratoga Springs City Court Judge Jeffrey D. Wait has announced his candidacy for state Supreme Court for the Fourth Judicial District, which includes Franklin and St. Lawrence counties among others.

Judge Wait also serves as acting County Court Judge and supervising judge for the town and village justice courts for four counties.

The Supreme Court position sought by Judge Wait will be filled at the general election in November.

Prior to taking the bench, Judge Wait was an attorney for 21 years. He started his career as an assistant district attorney in Suffolk County, later worked for the New York Board of Elections, and was Saratoga Springs city attorney for three years.

Judge Wait and his wife, Mary Lou, are both graduates of Saratoga Springs High School, and each of their three daughtersgraduated from the school.

CANTON — A Chase Mills woman was charged Sunday by St. Lawrence County sheriff’s deputies with first-degree promoting prison contraband and third-degree criminal possession of a controlled substance.

Angela M. Swinyer, 41, of 829 Ruddy Road, is accused of trying to bring a narcotic drug into the county jail for an inmate during a visit, deputies said.

Ms. Swinyer was arraigned in Village Court and released to the supervision of probation.
